Welcome

These Terms of Use (“Terms”) govern your access to and use of Noctra – Dream Journal & AI and any related services we provide (collectively, the “Service”), operated by Hien Nguyen (“we”, “our”, or “us”).

Noctra is a personal dream journaling application that allows users to record, reflect on, visualize, and explore their dreams through local and optional AI-powered features.

By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction) to use the Service. If you are under 18, you must have permission from a parent or legal guardian.

2. Use of the Service

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial use, subject to these Terms.

You agree not to:

  • Copy, modify, distribute, sell, lease, or sublicense any part of the Service except as permitted by law.
  • Reverse engineer, decompile, or attempt to extract source code except where such activity is expressly permitted by applicable law.
  • Use the Service for unlawful, harmful, abusive, misleading, or fraudulent purposes.
  • Attempt to gain unauthorized access to systems, networks, or data related to the Service.
  • Interfere with the operation, security, or integrity of the Service.

3. User Content

Some features of Noctra allow you to create, store, and process dream entries, including text, voice recordings, symbols, reflections, generated insights, and generated visualizations (“User Content”).

Your ownership

You retain ownership of your User Content. We do not claim ownership of your dream entries, recordings, reflections, or related materials.

Our limited license to operate the Service

You grant us a limited license to host, process, transmit, display, and store your User Content only as necessary to provide, maintain, secure, and improve the Service in accordance with our Privacy Policy.

You are responsible for:

  • Ensuring you have the legal right to create, upload, process, and use any User Content within the Service.
  • Ensuring your User Content does not violate any law, regulation, intellectual property right, privacy right, or other third-party right.
  • Understanding that dream interpretations and visualizations are subjective and provided for personal reflection only.
  • Reviewing any generated outputs before relying on them.

4. Privacy

We process personal data in accordance with applicable law and the Privacy Policy associated with Noctra.

5. Subscriptions & Payments

Some features of the Service may require payment, a subscription, or an in-app purchase. Premium features may include enhanced AI insights, premium dream visualizations, advanced pattern analysis, and extended usage limits.

If you purchase a subscription or other digital product through the Apple App Store:

  • Payment will be charged to your Apple ID account at the time of purchase confirmation.
  • Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • You can manage or cancel subscriptions in your Apple ID account settings after purchase.

Except where required by law or platform policy, purchases are non-refundable. We do not receive or store your full payment details.

6. Intellectual Property

The Service, including its software, design, interface, features, branding, text, graphics, and other materials, is owned by or licensed to us and protected by intellectual property and other applicable laws.

You may not use our trademarks, logos, app name, or brand assets without prior written permission.

7. AI / Generated Content

Some features of the Service use artificial intelligence (“AI”) to generate dream insights, symbolic interpretations, summaries, follow-up prompts, or visualizations based on your input.

  • AI-generated outputs are automatically generated and may be inaccurate, incomplete, subjective, or unsuitable for your intended purpose.
  • Dream interpretations are not scientifically proven and should be considered for personal reflection, entertainment, or journaling purposes only.
  • You should not rely on AI outputs as a substitute for professional advice, including medical, psychological, legal, financial, or other regulated advice.
  • You are responsible for reviewing and interpreting any AI-generated content before relying on it.
  • Some AI features may process your dream content using third-party AI services. These features are optional and may require your consent before use.
  • We do not guarantee that AI-generated outputs will be error-free, available at all times, or appropriate for any particular use case.
Important

AI features are intended to support journaling and self-reflection. Final responsibility for interpreting dream content remains with you.

8. Third-Party Services

The Service may integrate with or rely on third-party services, including AI providers, analytics services, cloud infrastructure, and payment platforms to enable certain features such as dream analysis, visualization, subscriptions, and diagnostics.

Your use of third-party services may also be subject to those providers’ terms, privacy policies, and practices. We are not responsible for third-party content, availability, or services beyond our reasonable control.

9. Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.

Noctra is intended for personal journaling and self-reflection purposes only. We do not guarantee the psychological, spiritual, symbolic, or factual accuracy of any dream interpretations or generated outputs.

We do not guarantee that the Service will be uninterrupted, secure, error-free, or that defects will always be corrected.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenues, business opportunities, goodwill, data, or other intangible losses arising out of or related to your use of the Service.

To the extent liability cannot be fully excluded, our total liability for any claim arising out of or related to the Service shall not exceed the amount you paid, if any, for the Service in the twelve (12) months preceding the event giving rise to the claim.

11. Termination

We may suspend, restrict, or terminate your access to the Service at any time if you violate these Terms, if required by law, or if we discontinue part or all of the Service.

You may stop using the Service at any time. Sections that by their nature should survive termination will survive.

12. Changes to Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after the updated Terms become effective means you accept the revised Terms.

13. Governing Law

These Terms are governed by the laws of Vietnam, without regard to conflict of law principles, except where consumer protection laws in your jurisdiction require otherwise.

Any dispute arising from these Terms or the Service will be resolved in the competent courts of Vietnam, unless applicable law provides otherwise.
